The purpose of this program shall be to provide necessary assistance on a temporary basis to needy families with children and to provide parents, legal guardians, or other caretaker relatives of children with job preparation, work opportunities, enforcement of child support and other necessary support services to enable these named individuals to become self-sufficient and leave the program The decision of the commissioner on any appeal shall be final, subject to the right to judicial review of contested cases under Chapter 13 of Title 50.</td> </tr> </table> <table border="0" width="100%" cellspacing="4" cellpadding="4"> <tr> <td valign="top" width="1%" style="white-space:nowrap;text-align:left;width:18px;"><a style="white-space:nowrap;" name="290-2-28-.07(3)">(3)</a></td> <td valign="top" style="text-align:left" class="leftalign"> Nothing contained in these rules shall operate to create an entitlement to the receipt of cash assistance under the Georgia TANF Program.</td> </tr> </table> <h2><a href="/GAC/290-2-28-.08" name="290-2-28-.08" title="290-2-28-.08">Rule 290-2-28-.08 Confidentiality</a></h2> <P>Records, information and communication of the department including county departments of family and children services, which identify applicants for or recipients of cash assistance under the TANF Program shall be confidential and shall not be considered public records. The disclosure of information concerning applicants and recipients will be limited to purposes directly connected with administration of the TANF Program and/or the department.</P> <h2><a href="/GAC/290-2-28-.09" name="290-2-28-.09" title="290-2-28-.09">Rule 290-2-28-.09 Domestic Violence</a></h2> <P>The department shall screen and identify applicants and recipients of Georgia TANF Program who have a history of being domestic violence victims. The department shall refer such individuals to counseling and supportive services. If there is a determination of good cause by the department, the department shall waive program requirements, such as work requirements, cooperation with child support, residency, family cap and lifetime limits for so long as necessary, when such requirements make it more difficult for the victim to escape domestic violence or unfairly penalize individuals who are or have been victims of domestic violence or individuals who are at risk of further domestic violence.</P> <h2><a href="/GAC/290-2-28-.10" name="290-2-28-.10" title="290-2-28-.10">Rule 290-2-28-.10 Residency</a></h2> <P>Applicants and recipients must be residents of Georgia. Families moving into Georgia after receiving cash assistance from another state shall be paid cash assistance amount for their family size for which they would have received in the previous state of residence or the Georgia cash assistance amount whichever is less, for a period up to one year. This provision shall apply until the end of the twelfth month of residency in Georgia. In addition, families moving into Georgia from another state shall receive cash assistance only for the time period for which they would have been eligible in the previous state of residence or the time period permitted by Georgia, whichever is shorter.</P> <h2><a href="/GAC/290-2-28-.11" name="290-2-28-.11" title="290-2-28-.11">Rule 290-2-28-.11 Lifetime Maximum</a></h2> <P>Cash assistance to a recipient who is not a minor child and who is head of the household or married to a head of the household shall be limited to a lifetime maximum of 48 months, whether or not consecutive, beginning January 1, 1997, unless the department determines that a recipient qualifies for an extension on grounds of hardship pursuant to Rule <a title="290-2-28-.19" href="290-2-28-.19">290-2-28-.19</a>.</P> <h2><a href="/GAC/290-2-28-.12" name="290-2-28-.12" title="290-2-28-.12">Rule 290-2-28-.12 Basic Non-Financial Eligibility Requirements</a></h2> <P>The following non-financial criteria are considered in determining TANF eligibility.</P> <table border="0" width="100%" cellspacing="4" cellpadding="4"> <tr> <td valign="top" width="1%" style="white-space:nowrap;text-align:left;width:18px;"><a style="white-space:nowrap;" name="290-2-28-.12(a)">(a)</a></td> <td valign="top" style="text-align:left" class="leftalign"><B>Age.</B> Assistance will be provided for children under age 18. Failure to ensure that children attend school will result in sanctions. A $1,500.00 exclusion of the equity value of one vehicle is allowed if the family is not using the vehicle for work, training or education preparatory to employment or job search.</td> </tr> </table> <table border="0" width="100%" cellspacing="4" cellpadding="4"> <tr> <td valign="top" width="1%" style="white-space:nowrap;text-align:left;width:18px;"><a style="white-space:nowrap;" name="290-2-28-.13(4)">(4)</a></td> <td valign="top" style="text-align:left" class="leftalign"><B>Income.</B> Income limits shall be based on the state's gross income ceiling and standard of need. To be determined eligible, the income of all family members must be below the gross income ceiling. Net income shall be compared to the state's standard of need. The state shall pay the deficit up to the family maximum. <table border="0" width="100%" cellspacing="4" cellpadding="4"> <tr> <td valign="top" width="1%" style="white-space:nowrap;text-align:left;width:18px;"><a style="white-space:nowrap;" name="290-2-28-.13(4)(a)">(a)</a></td> <td valign="top" style="text-align:left" class="leftalign"> The income of all family members shall be considered except as exempted in (c) below. Income including, but not limited to, wages, unemployment benefits, child support, contributions, and social security benefits shall be considered in determining eligibility. An IDA may be established as a trust by or on behalf of an individual for the following purposes: post-secondary education, first home purchase, and/or business capitalization. The individual may only contribute amounts that are derived from earned income as defined in section 911(d)(2) of the Internal Revenue Code of 1986. or</td> </tr> </table> <table border="0" width="100%" cellspacing="4" cellpadding="4"> <tr> <td valign="top" width="1%" style="white-space:nowrap;text-align:left;width:18px;"><a style="white-space:nowrap;" name="290-2-28-.14(j)">(j)</a></td> <td valign="top" style="text-align:left" class="leftalign"> The recipient is pregnant and fails to participate actively in prenatal care as arranged by the department at a level defined by the department.</td> </tr> </table> <table border="0" width="100%" cellspacing="4" cellpadding="4"> <tr> <td valign="top" width="1%" style="white-space:nowrap;text-align:left;width:18px;"><a style="white-space:nowrap;" name="290-2-28-.14(k)">(k)</a></td> <td valign="top" style="text-align:left" class="leftalign"> Paragraphs (f) and (g) of this rule shall not apply if the applicant or recipient has no parent or legal guardian whose whereabouts are known, or no parent or legal guardian of the applicant or recipient allows the applicant or recipient to live in the home of that of the parent or legal guardian, or the department otherwise determines that there is good cause not to apply the prohibitions contained in said paragraphs.</td> </tr> </table> <h2><a href="/GAC/290-2-28-.15" name="290-2-28-.15" title="290-2-28-.15">Rule 290-2-28-.15 Family Cap</a></h2> <P>Assistance paid to a recipient family shall not include an increase in benefits as a result of the birth of a child during the period in which the family is eligible for TANF assistance or during a temporary period in which the family or recipient is ineligible for TANF assistance pursuant to a sanction for failure to comply with eligibility requirements. This rule shall be implemented as follows:</P> <table border="0" width="100%" cellspacing="4" cellpadding="4"> <tr> <td valign="top" width="1%" style="white-space:nowrap;text-align:left;width:18px;"><a style="white-space:nowrap;" name="290-2-28-.15(a)">(a)</a></td> <td valign="top" style="text-align:left" class="leftalign"> For families who apply for assistance on or after May 1, 1997, the time limit will be a total of ten months;</td> </tr> </table> <table border="0" width="100%" cellspacing="4" cellpadding="4"> <tr> <td valign="top" width="1%" style="white-space:nowrap;text-align:left;width:18px;"><a style="white-space:nowrap;" name="290-2-28-.15(b)">(b)</a></td> <td valign="top" style="text-align:left" class="leftalign"> For families who began receiving assistance prior to May 1, 1997, but who have not received assistance for 24 months, the time limit will be ten months beginning May 1, 1997;</td> </tr> </table> <table border="0" width="100%" cellspacing="4" cellpadding="4"> <tr> <td valign="top" width="1%" style="white-space:nowrap;text-align:left;width:18px;"><a style="white-space:nowrap;" name="290-2-28-.15(c)">(c)</a></td> <td valign="top" style="text-align:left" class="leftalign"> For families who have received assistance for 24 or more months after January 1, 1994 and before May 1, 1997, the 24 month time limit will apply. The counties selected for this pilot will provide evidence that the local cooperation needed to allow the program to be successfully implemented has been assured. The purpose of this pilot program will be to require school attendance of all teenagers. A teenager shall be considered to have met the attendance requirement by having no more than two full days of unexcused absences in a calendar month.
